Height is measured from the finished ground level, or from the top of a retaining wall. Where a retaining wall stands higher than the ground it holds back, that extra height counts against the fence's allowed height. Sec. 16-29.001(25)(b). The 5 ft fence-plus-wall limit gives way where the slope will not allow a lower retaining wall.
