Permit Requirements
Required, and every fence must be reviewed and approved by the city engineer before construction. Submit drawings with dimensions, the final plat of the property, your driver's license, and a letter of approval from the neighbor if attaching to a neighbor's fence. The application may be emailed to cityhall@cityoflovejoy.com or filed at Lovejoy City Hall. Engineering Department, 2296 Talmadge Road, Mon-Fri 8am-4pm: 770-471-2304, permits@cityoflovejoy.com
Height - Front Yard
4 ft max, ornamental only: brick, masonry, picket or split rail. No chain link or any other wire fence. Zoning Sec. 702 bars a fence from the front-yard setback; the 2017 fence ordinance allows 4 ft there and the city's fence permit form has a front-yard option.
Height - Side/Rear
Most homes: 6 ft max. An older section of the city's own zoning code says 8 ft, but the newer fence ordinance, the one the city's permit form follows, says 6 ft. Build to 6 ft unless the permits office says otherwise: 770-471-2304. Non-residential property: 8 ft, side and back yards only.
Height Notes
The fence ordinance measures height from natural ground level to the top of the fence, at any point along its length. Zoning Sec. 707 measures fence height differently: from the top of the adjacent street curb, the alley surface or the officially established grade, whichever is higher, and on a lot line shared with a neighbor, from the average grade of the lower lot. On a lot that sits below street level the two give different answers, so ask the permits office which one applies: 770-471-2304. Inside a corner sight triangle, Sec. 706 measures height at the top of the curb on the adjacent street or alley, or from the edge of the nearest traveled way where there is no curb. A fence may not encroach into an undisturbed buffer, or into a required land use or landscaping buffer without authorization from the zoning administrator or city council.
Corner Lots
A corner lot has two front yards: the 4 ft ornamental front-yard rule applies along both streets. Keep clear the triangle measured 20 ft along the property lines from where two streets meet, or 15 ft along both the street and alley line: nothing sight-blocking over 30 in, and tree branches no lower than 8 ft.
Materials Allowed
Front yard: ornamental only. Brick, masonry, picket or split rail. Side and back yards: no material restriction.
Materials Prohibited
Chain link and any other type of wire fence, in a front yard.

Setbacks
Without a written agreement with your neighbor, each fence must sit at least 3 ft inside the property line, leaving a 6 ft gap for maintenance. With a written agreement between both owners, two fences may connect on the property line. Never in a public right-of-way or an undisturbed buffer. In an easement: needs documented permission from the easement's titled owner and city engineer approval. A fence may not block emergency access or obstruct pedestrian or vehicle traffic.
Design Requirements
Structural supports go on the inside of the fenced yard. Fences must be kept clean, undamaged and in good condition; a violation notice gives ten business days to repair or remove before a citation to municipal court.
Gates
No size or type rules. Homeowners are responsible for maintaining the fences, gates and driveways on their property.
Floodplain Rules
Standard floodplain regulations apply
Notes
Governed by city code Sec. 10-1043; Lovejoy has its own fence ordinance and does not follow Clayton County's. City Hall, 2296 Talmadge Road: 770-471-2304, permits@cityoflovejoy.com. Community Development office: 11714 Hastings Bridge Road, Suite D, Mon-Fri 9am-2pm
