Floodplain Rules
Fences are allowed in the county's Flood Prone (F-P) zone, but in a mapped flood hazard area any development, meaning any man-made change to land, needs a development permit first. Floodway (the stream channel and nearby land that must stay open to carry floodwater): no new construction or other development unless a registered professional engineer certifies it will not raise flood levels or widen the floodway. In a mapped flood hazard area along a stream with no flood elevation or floodway data from any official source: no encroachment, including fill or structures, within the stream's width or 20 ft of the top of the bank, whichever is greater, unless a registered professional engineer certifies it will not raise flood levels at all. In a mapped flood hazard area along a stream that has flood elevations but no mapped floodway: the same 20 ft rule applies, and any other encroachment in the flood area needs an engineer's certification that, with all other development, it will not raise flood levels more than 1 ft. Ask Planning whether a fence counts as an encroachment. River and stream buffers: within 100 ft of the bank of the Oconee, Middle Oconee or Apalachee River only the uses the code lists are allowed, and construction is barred in the natural buffer of at least 25 ft along other streams except a few listed uses; fences are not on either list, so ask Planning before fencing near a stream.
