Permit Requirements
Required for any fence or wall. The zoning section mentions a permit only over 3 ft, but the building chapter makes it unlawful to build any fence without one, so apply regardless. Building without a permit doubles the fee. Submit through the GovWell online portal: the fence's location, size, distance to property lines and streets, and material. Height - Front Yard
Not allowed. In residential districts no fence may stand in the front yard, or anywhere between a street right-of-way and the front wall of the house. Mixed-Use district: a fence facing the street is 40 in max.
Height - Side/Rear
6 ft max. A fence securing a pool or tennis court in the back yard may reach 10 ft if it sits 1 ft farther from the property line for each foot over 6 ft.
Height Notes
The code does not say how fence height is measured. Business districts: 8 ft max. Industrial: 10 ft max. Either one next to homes: 8 ft on the side and back, 6 ft in front. The board of appeals can grant a variance from these height limits.
Corner Lots
Two rules apply. Zoning code: nothing that blocks the view within 20 ft of the point where two street or railroad right-of-way lines meet. Traffic code: nothing between 3 ft and 15 ft tall in that same 20 ft. Business and industrial lots on a corner: no fence closer to either street than the front setback line. Garden City Code Sec. 90-98, Sec. 78-14
Materials Allowed
Chain link, wood and masonry.
Materials Prohibited
Wire fences other than chain link, and plain metal such as roofing tin. Barbed or razor wire only on a business or industrial fence 6 ft or taller, or for farm use. Mixed-Use district: no barbed wire, razor wire or chain link.
Historic Districts
None. There is no historic district and no design review for fences.
Setbacks
None for a home fence; the code sets no distance from a side or back property line. Business and industrial fences next to homes: 5 ft from the line, kept landscaped. A pool or tennis-court fence over 6 ft: 1 ft farther from the line for each foot over 6 ft.
Design Requirements
A one-sided wood fence puts its finished side toward the property line. Keep it maintained: replace missing parts, repaint, repair stucco, control weeds. Temporary construction fences: allowed under 18 months with city administrator approval. Mixed-Use district: street-facing fences in picket wood, stone, composite or ornamental metal, finished side to the street.
Gates
Pool gates self-closing, self-latching and opening away from the pool. No other gate rule for a home fence.
Floodplain Rules
The flood code does not name fences. A fence in the mapped flood zone needs a development permit as a man-made change to the land, and nothing goes in the regulatory floodway without an engineer's certification of no rise in flood levels. The erosion code exempts fences as minor land disturbance, so stream buffers do not apply. Garden City Code Sec. 38-20, 38-31
Color Restrictions
None for a home fence. Business and industrial fences next to homes: wood painted or stained, concrete block painted or stuccoed.
Notes
Governed by the Garden City Code, Zoning Sec. 90-96 (Walls and fences), last changed in 2008, with the fence permit in Sec. 18-6. Chatham County's ordinance does not apply inside the city.
