Permit Requirements
Building permit required for structures 120 sq ft or greater. Fences in residential front yards must be set back 3 ft from right-of-way.
Height - Front Yard
4.5 feet maximum (fence face); posts max 5.5 feet. Within minimum required front yard setback.
Height - Side/Rear
6 feet maximum (fence face); posts max 7 feet. Outside the minimum required front yard setback.

Height measured from average natural ground surface to top edge. Section 206(e)(3)b, amended May 2009. Deviations require special exception variance.
Pool Fences
Materials Allowed
Brick/stone masonry, wrought iron, painted/stained wood, vinyl, max 2x2-inch wood lathe, chain link (galvanized or vinyl coated).
Materials Prohibited
Barbed wire, razor wire, woven wire (chicken wire, hog wire), sheet metal, plywood, and masonite.
Setbacks
Front yard: minimum 3 feet from right-of-way. Side and rear: no setback required.
Design Requirements
Finished surface must face abutting property/street. Max 75% opaque — at least 25% visually transparent. Solid walls and board-on-board fences NOT allowed.
Gates
Gates subject to same height limits as fence face.
Retaining Walls
Retaining walls exempt from fence height restrictions.
Notes
One of the most detailed fence codes in the region. UDC Section 206(e)(3)b. 75% opacity rule requires open/semi-open fencing. Contact Planning & Development at 912-576-5651.
