Height Notes

Materials Prohibited

Floodplain Rules
In a mapped flood hazard area, a city development permit comes before any development, which the code defines as any man-made change to land, including buildings or other structures. The flood rules never name fences, so ask the Zoning Administrator whether yours needs one. Floodway (the stream channel and the land beside it that must stay open to carry floodwater): nothing may go in unless an engineer certifies it will not raise flood levels or widen the floodway. Along a stream in a mapped flood hazard area where no floodway is mapped and no other flood data are available: no structure, fill or other encroachment within the stream's width or 20 ft of the top of the bank, whichever is greater, unless an engineer certifies it will raise flood levels no more than 1 ft. A fence that causes only minor soil erosion is exempt from the city's erosion-control rules. Clayton Code Secs. 18-19, 18-77, 18-101, 18-102, 18-152
Color Restrictions
None. The city sets no fence color rule.
Notes
Governed by the city's own zoning code (Chapter 46), not Rabun County's: a permit for every fence, 2 ft back from the right-of-way, a corner sight triangle, and a 6 ft pool fence. The code sets no fence height limit away from a street corner. Planning and Zoning Administrator · 706-949-3676 City Hall, 837 Hwy 76 W, Suite 101, Clayton, GA 30525
