Fence Regulations

Athens

Permit Requirements
Zoning permit required from Planning Department prior to fence construction. Any fence over 4 feet needs approval. Even shorter fences require permits in certain zones. Replacing more than 50% of existing fence also needs permit.
Height - Front Yard
4 feet maximum
Height - Side/Rear
6 feet typical with approval; 8 feet maximum in rear/side yards per Sec. 9-15-1
Height Notes
Section 9-15-1 Zoning & Development Standards. Within 10 feet of any public right-of-way: 4 feet maximum regardless of yard. Corner lots have more restrictive height requirements for visibility.
Corner Lots
More restrictive height requirements due to traffic visibility. Cannot obstruct sight triangles.
Materials Allowed
Standard residential materials. Wood and wrought iron preferred in historic districts.
Materials Prohibited
Vinyl fencing rarely approved in historic areas. Modern composite materials generally discouraged in historic districts unless specifically approved.
Historic Districts
Boulevard, Cobbham, Milledge Avenue historic districts require Historic Preservation Commission (HPC) design review. Adds 2-3 weeks to processing. Natural wood stains or traditional paint colors required.
Setbacks
Minimum 10-foot setbacks from certain easements. Cannot encroach on property lines without neighbor agreement. Drainage easements: fences cannot impede water flow. ACC Greenway setbacks apply near parks.
Design Requirements
Historic districts: wood/wrought iron preferred, must complement neighborhood character. University/Five Points area: restrict front-yard fences, emphasis on backyard enclosures. Ornamental aluminum recommended for corner lots.
